Travel exemptions for PMV holders: A Prospective Marriage (subclass 300) visa holder in the following circumstances: where the subclass 300 visa has been granted; and the subclass 300 visa application was lodged at least 12 months before submitting a travel exemption request. Australians wanting to marry foreigners will have to undergo a domestic violence check before they can apply to bring their loved ones into the country. The new measure will require Australian citizens and permanent residents to undergo a police check and show any adverse results to their partner or spouse before they can sponsor them. The domestic violence check is expected to take six weeks to process and will be covered by an additional $420 fee announced last week in the federal budget when the government also revealed it planned to introduce an English language test for foreign partners. Prospective Marriage Subclass 300 – longer validity period PMV SC 300 visas granted on or after 27 February 2021 will be allowed a validity period of up to 15 months. This change applies to applications made before, on or after 27 February 2021. The validity period granted will depend on the ‘circumstances of the individual’.
Some categories of visas require applicants to be outside of Australia at the time the visa is granted. The Department is aware that COVID-19 travel restrictions are affecting visa applicants, particularly applicants for family visas who have come to Australia. The Department is taking disruptions arising from the pandemic into account when considering visa applications. Visa applicants are being given additional time to complete the necessary requirements, including any current requirement to be offshore at time of visa grant. New partner visa requirements The new rules will only apply to new application and are expected to commence in November 2021 Both applicants and sponsors will need to meet (functional) English requirements. English requirements for visa applicants required for stage 2 (permanent visa) only. English requirements for sponsors to be met before sponsorship can be approved. Sponsors will be subject to character requirements. Partner visa application cannot be lodged without an approved sponsorship.
